"Therefore, it is decided to dismiss the requested precautionary measure", refers the order of the presiding judge Catarina Almeida e Sousa, dated today.

Pinto da Costa, 86, was sanctioned for "injury to honor and reputation and slanderous denunciation", in view of the criticism directed at the refereeing at the end of the match with Estoril Praia, which the team led by Sérgio Conceição lost (1-0), on March 30, on the 27th round of the I League.

The judgment issued today states that "by order of the Exmo. President of the CAS, of 05/15/24, the proceedings were referred to this TCA Sul for consideration and decision, noting that it is not feasible, in a timely manner, to constitute the arbitration panel".

Similarly, it is mentioned that "there are no exceptions or other prior issues that should be known from now on and that prevent the consideration of the merits of the requested measure".

Pinto da Costa accused the main referee António Nobre, from the Leiria association, of "not being qualified to referee" FC Porto's visit to Estoril, whose incidents led to the opening of proceedings against the SAD of the 'dragons', which was fined 15,810 euros, and its president, who was also critical of Tiago Martins, video referee (VAR) of that match.

António Nobre expelled goalkeeper Diogo Costa and forward Francisco Conceição, both from FC Porto, and Bernardo Vital, central defender of Estoril Praia, applying the same sanction after the final whistle to Luís Gonçalves, administrator of the SAD of the 'blue and whites'.

Pinto da Costa appealed for the first time the decision handed down by the CD of the FPF last week, when he ended a cycle of 15 terms and 42 years as president of FC Porto and witnessed the inauguration of André Villas-Boas, former coach of the 'blue and white' football team, against whom he lost the most participated elections in the club's history.

The transition of powers in the SAD, responsible for the management of FC Porto's professional football, will take longer, which is scheduled for May 28, two days after the final of the Portuguese Cup, in which the 'dragons' face the recently national champion Sporting, at the Estádio Nacional, in Oeiras, and will try to win the trophy for the third consecutive edition.

Pinto da Costa expressed his desire to symbolically accompany that game on FC Porto's bench, despite the sanction of the CD of the FPF affecting the technical areas of the venues and going beyond the date of the decision of the Portuguese Cup, a scenario that could have been countered, if the CAS had accepted the precautionary measure, which would produce suspensive effects.

The match with Sporting ends FC Porto's season and will mark Pinto da Costa's farewell to the SAD, whose presidency he has held since 1997, the year that company was created.
