Beware: Ticket scalping "above cost price is a crime"
Considered a crime of speculation, it can be punished with a prison sentence of between six months and three years, and a fine of not less than 100 days, recalls DECO PROteste.

Selling tickets for events above their face value is not only forbidden in Portugal, but is also considered a crime of speculation, punishable by imprisonment, DECO PROteste recalls.
"Selling a ticket for a show at a price higher than that set by the event organizer is forbidden in Portugal. Considered a crime of speculation, it can be punished with imprisonment of between six months and three years, and a fine of no less than 100 days. If the seller acted negligently, the applicable imprisonment is reduced to one year and the fine to a minimum of 40 days", explains the consumer protection organization.
Furthermore, selling an invitation (i.e. a ticket with no acquisition cost), even for the box office price, is also considered a crime of speculation.
"Some online platforms advertise the resale of tickets between individuals, with prices above face value, in some cases charging very high commissions for the service. Although they assume the role of mere intermediaries and are not headquartered in Portugal, an urgent solution is needed to regulate and monitor the operation of these platforms", argues DECO PROteste.
The consumer protection organization adds that "the resale of tickets is only permitted if the seller does not make a profit from the transaction, i.e. if the ticket is sold at its face value".
