Value of prescribed tax debts falls 55% in 2023 to 19.6 million

The value of tax debts considered statute-barred fell by 55.2% in 2023 compared to the previous year, to 19.6 million euros, according to the 2023 General State Account (CGE) published today by the Directorate-General for the Budget (DGO).

"The statute of limitations for tax debts in 2023 was 19.6 million euros, which represented a decrease of 24.1 million euros (-55.2%) compared to the previous year", reveals the document submitted on Wednesday to the parliament and the Court of Auditors and released today by the DGO.

VAT remained, in 2023, as the tax with the greatest weight (43.3%) in the total value of the statute of limitations, however, showing a decrease in the prescribed value, of minus 16.6 million euros (-66.3%), compared to the previous year.

Among the taxes with the greatest weight in the debts that prescribed are IRC (29.7%) and IRS (19.5%).

The statute of limitations for tax debts occurs, as a general rule, eight years after the year "in which the generating fact of the tax obligation occurred, except for the causes of suspension and interruption of the legal term".

According to the CGE, in 2022, the aggregate value of debt cancellations recorded in State revenue was 10,509.9 million euros, which represents an increase of 1,454.7% compared to the previous year.

This increase was mainly due to Stamp Duty (IS) and compensatory interest, with an increase, as a whole, of 9,838.2 million euros when compared to 2022, details the document.

According to the CGE, "this increase is essentially due to the cancellation of an IS self-assessment relating to item 2 --- lease contracts, in the amount of 9,796.9 million euros (nine billion euros in tax and 796.9 million euros in compensatory interest), as a result of the cancellation of the respective contract, which led to the termination of the tax enforcement proceedings".

"The issue involves cancellations observed following the submission of replacement tax returns by taxpayers and the partial or total success of legal challenges and voluntary complaints", it indicates.
