AdC accuses multinational consulting firm of anti-competitive practices
The Competition Authority (AdC) has accused a multinational technology consulting firm of anti-competitive practices in the labor market, without revealing the name of the group, according to a statement released today by the entity.

"The Competition Authority (AdC) is investigating anti-competitive behavior in the labor market, practiced by a multinational technology consulting group, between 2014 and 2021", the entity reported.
Specifically, it detailed, an accusation was issued "directed at two companies in the group responsible for the practice, and the parent company, for having concluded that there is a reasonable possibility that a sanctioning decision will be issued for entering into non-hiring agreements with competing companies".
At issue is an investigation opened by the AdC in March 2022, which concluded that there are indications that several companies entered into non-hiring or "no-poach" agreements, through which they committed to not hiring or not making spontaneous offers to employees of competing companies.
This type of agreement is prohibited by the Competition Law, since it limits the autonomy of companies in defining strategic commercial conditions and is likely to affect employees by reducing their negotiating power and salary level and depriving them of labor mobility.
According to the AdC, three of the groups investigated -- two multinationals and one domestic technology consulting company -- collaborated with the investigation and voluntarily paid the fines applied, in the amounts of 1,323,000 euros, 2,481,000 euros and 278,000 euros (reduced compared to what they would have incurred if they had not collaborated).
For the multinational group that did not collaborate, the investigation continues with the issuance of an accusation (notice of illegality).
The three companies in the group accused have the right to be heard and present their defense and, once this first phase of the process is completed, the AdC will adopt a final decision.
