Harvey Weinstein, 72, appeared in New York’s highest court on Thursday, where he learned that his rape and sexual assault trial will be rerun in September on a date to be determined.
Judge Curtis Farber said the trial will begin “sometime after Labor Day [which is Sept. 2 in the United States],” and that Weinstein will remain in jail in the meantime.
Harvey Weinstein is serving a 23-year sentence in a New York state prison after he was convicted in 2020 of sexually assaulting a production assistant in 2006 and raping an aspiring actress in 2013.
On Aug. 25, New York’s highest court threw out Harvey Weinstein’s rape and sexual assault convictions, finding that the trial judge made “egregious” errors that prejudiced the former movie mogul.
The judge also faulted the lower court judge’s decision to allow witnesses to testify about allegations that were not part of the charges.
“We conclude that the trial court improperly admitted evidence of uncharged prior bad acts that were not probative of the uncharged crimes for which the defendant was on trial,” the decision said.
“The remedy for these errors is a new trial,” it read.
The state appeals court’s decision reopens a chapter in the national reckoning over powerful men’s sexual misconduct that began in 2017 with a torrent of accusations against Weinstein. Victims may now be forced to relive their stories on the witness stand.
