Brazil wants social media X to pay 180.5 million for moral and social damages

The agency, which brings together pro bono lawyers who work in collective defense of human rights through collective lawsuits in Brazil, alleges that the conduct of businessman Elon Musk, owner of X, "represents the instrumentalization of digital platforms for illicit purposes".
Musk has publicly attacked Justice Alexandre de Moraes of the Brazilian Supreme Federal Court, insinuating that he manipulated the 2022 presidential elections, won by the current President, Luiz Inácio Lula da Silva. The South African businessman also accuses Moraes of issuing court orders that do not respect freedom of expression.
The DPU's action filed with the Brazilian Federal Court also states that Musk seriously violated the Democratic Rule of Law by publicly threatening not to comply with court orders imposed on X.
According to the agency, Musk's statements come at a delicate time for Brazil, "which is trying to appease the tensions caused by far-right sectors involved in the attempted coup d'état", referring to the attacks promoted by supporters of former president Jair Bolsonaro on the headquarters of the Three Powers, in Brasília, on January 8, 2023.
In addition to the compensation, the lawsuit proposes a fine of 500 thousand reais (90.2 thousand euros) for each episode of disobedience to court decisions made by X in the South American country.
The DPU also requested that the Brazilian Justice determine that the social network X comply with a series of measures, such as the adoption of a moderation policy in accordance with the rights to freedom of expression and information, the implementation of a cooperation system with judicial authorities and the creation of partnerships with organizations that work in the verification of facts and combat the dissemination of fake news.
