According to the ruling of the Central Criminal Investigation Court (TCIC), to which Lusa had access, the young Portuguese man, whose arrest was announced on Thursday by the Judiciary Police (PJ), is indicted for 11 crimes: one of qualified homicide, five attempted homicides, two of child pornography, one of criminal association, one of public incitement to a crime and one of public apology for a crime.
The investigating judge Carina Realista Santos considered that the crimes in question "generate strong social alarm, which is fully justifiable, given their particular seriousness, (...) configuring a complete disturbance of public order and tranquility".
"It is absolutely notorious the concrete danger of the continuation of the criminal activity, either due to the reiteration of the facts, or due to their expressive seriousness, or even due to the personality evidenced by the defendant in the magnitude of the brutality and violence", refers the judicial ruling, which also emphasizes the young man's "total indifference and contempt" for the crimes.
For the court, the 17-year-old Portuguese young man shows "very deep-rooted extremist and radical ideas" and exerts an "evident ascendency" over the other members of the group on the Discord platform, which is why it understood that there was a risk of disturbing the investigation for the acquisition of evidence, "since certainly everyone would obey the defendant's commands of silence if contacted".
In the group on this platform, according to the information provided by the PJ on Thursday, content about serious self-harm of young people, mutilation and death of animals, Nazi extremist propaganda, incitement and practice of the "mission" of committing massacres in schools and, still, sharing and selling child pornography.
"The nature of the crimes in question, the seriousness, the intensity and extent of the facts in question, the criminal energy revealed, the foreseeability that when the defendant is brought to trial he will be sentenced to an effective sentence of deprivation of his liberty, impose the application of a coercive measure of deprivation of liberty", can still be read in the ruling.
The magistrate also justified that she could not apply the house arrest measure, because it was through the Internet that the young man would practice the crimes for which he was indicted and access to this technology would be facilitated by staying at home.
The investigation of this case began at the end of last year and was carried out by the National Counter-Terrorism Unit of the Judiciary Police (PJ) and was in charge of the Department of Investigation and Criminal Action (DIAP) of Lisbon, also counting on the collaboration of the Federal Police of Brazil.
