Alan Eugene Miller, the inmate who survived a lethal injection in 2022, now has a new — and second — execution date. The new execution is set for Sept. 26, according to documents obtained by CBS News on Wednesday. In addition to Miller surviving the execution attempt — after being stabbed repeatedly for an hour and a half while strapped to a gurney — there’s another twist: The 59-year-old is set to be executed by nitrogen gas. Miller has been on death row since 2000, a year after he fatally shot three co-workers. Witnesses testified that Miller accused the three men of “spreading rumors” about him, though the exact nature of the rumors was not specified. The court found the murders to be especially heinous. Nitrogen gas not new, but nearly so Nitrogen gas has been used in one other execution, that of Kenneth Smith in January. The 58-year-old was executed in that manner, also in Alabama, after the state’s executioners were unable to establish intravenous access to give him a lethal injection. The execution was widely criticized, with Smith himself saying before he died that “the state of Alabama is taking a step backward in humanity.” The execution was also criticized by the United Nations, as well as the European Union. In Miller’s case, he is the first inmate to request to be executed in this manner, and the state has agreed to his request. Capital punishment is no longer practiced in most countries, but not all death sentences are carried out.
