The proposal acknowledges the medicinal uses of cannabis and recognizes that it has less potential for addiction than other, more dangerous drugs. The plan approved by Attorney General Merrick Garland does not fully legalize marijuana for recreational use.

The initiative aims to remove marijuana from the current Schedule 1, which includes substances that are more addictive, such as heroin, and move it to Schedule 3, where others with a more moderate potential for addiction are placed.

US President Joe Biden announced in October 2022 a series of measures to eliminate federal convictions for people penalized for simple possession of marijuana, in order to remove some of the obstacles they could face in terms of access to employment or housing.

Biden also called on health and judicial authorities to rethink the penalties associated with marijuana.
