The man who was sentenced to 30 years in prison for attacking the husband of former U.S. House Speaker Nancy Pelosi during a break-in at their home was back in court Tuesday because of a mistake by the judge. 

David DePape was sentenced to 30 years in prison on May 17 for breaking into the Pelosis’ San Francisco home in the early morning hours of Oct. 28, 2022, and striking Paul Pelosi in the head with a hammer.

But during the sentencing hearing, U.S. District Judge Jacqueline Scott Corley did not give DePape a chance to address the court, a “clear error” under federal sentencing rules, the judge overseeing the case wrote in an order that was obtained by Reuters.

The hearing was reopened Tuesday so that DePape could speak on his own behalf.

The man was sentenced on May 17 to 30 years in prison for two federal crimes: attempted kidnapping of a U.S. official and assault on an immediate family member of a U.S. official.

At his trial, he admitted breaking into the former House speaker’s home and carrying out the attack — something he had already done in interviews with police and the media.

However, he claimed he never intended to harm Nancy Pelosi’s husband, Paul Pelosi. 

Nancy Pelosi was speaker of the U.S. House at the time of the attack, which raised concerns about politically motivated violence in the run-up to the 2022 midterm elections.

Paul Pelosi said at the time that the break-in at the couple’s home in the city’s Pacific Heights neighborhood was part of a plan to kidnap Nancy Pelosi and interrogate her about a supposed corrupt conspiracy involving her and other prominent liberals.

The sentence the judge imposed was in line with what prosecutors had asked for, which was the maximum penalties for each charge — 20 years for the kidnapping count and 30 years for the assault count.

However, she rejected the government’s request that 10 years of those sentences be served consecutively. Instead, the sentences will run concurrently.
