Bosnian Serb entity withdraws ‘foreign agents’ law

The Government of Bosnia's Serb entity withdrew a controversial law today that would have required non-governmental organizations (NGOs) that receive international funds to register as "foreign agents," aiming to bring it in line with European legislation.

The bill, adopted in September and which constituted a first legislative step, followed by public debate, was strongly criticized by the European Union (EU), the United States and the Organization for Security and Cooperation in Europe (OSCE).

The process had been initiated by the president of Republika Srpska [RS, the Serb entity of Bosnia-Herzegovina], the separatist Milorad Dodik, after the adoption, in July 2023, by the RS Parliament, of laws rejecting the authority of the international high representative and of the country's Constitutional Court.

Bosnia is divided into two entities, a Serb one and a Bosnian-Croat one, which enjoy a high degree of autonomy.

The "foreign agents" law was on the agenda of the current session of the RS Parliament, but its withdrawal was announced by the deputy prime minister and minister of justice of the entity, Milos Bukejlovic.

Shortly after, Dodik reacted on social media: "As Republika Srpska is attached to the European path [of Bosnia], we have agreed to withdraw this law and to align it more with the laws in force in certain European countries, so that it is in line with European legal practice".

The political leader of the Bosnian Serbs, who maintains relations with Russian President Vladimir Putin, added that the law will be returned to Parliament.

According to the withdrawn text, NGOs "financially or otherwise supported by foreign entities" would be qualified as "foreign influence agents" and would not be authorized, under penalty of being outlawed, to carry out "political activities".
