Pilot charged with murders after landing in Caparica knows sentence

The pilot accused of two homicides during an emergency landing on a beach in Caparica after an engine failure in August 2017, will hear the verdict of the Almada Court today.

The instructor pilot Carlos Conde de Almeida, the only defendant in the process, was charged with dangerous driving of an air transport vehicle and two crimes of negligent homicide.

The emergency landing of the Cessna 152 light training aircraft carrying the instructor pilot and a student on board, on August 2, 2017, caused the death of an eight-year-old girl and a 56-year-old man, who were on the beach of São João da Caparica, in Almada, in the district of Setúbal.

In the final arguments, on March 7, Carlos Conde de Almeida's defense requested his acquittal, but the Public Prosecutor's Office argued that the defendant should be convicted.

The Public Prosecutor's Office considers that the instructor pilot exchanged the dangers to the two crew members of the aircraft -- instructor and student -- of a landing elsewhere, or of a water landing, for the "certain death of others", on a beach with hundreds of people.

According to the allegations of the Public Prosecutor's Office, Carlos Conde de Almeida should have chosen the emergency landing site as soon as the failure was detected, but he only did so too late, because he wasted time in successive attempts to restart the aircraft's engine, which lasted much longer than normal.

The defense lawyer for the instructor pilot, Nuno Pires de Lima, criticized the investigation by the Public Prosecutor's Office, which he considered to be "poorly prepared and poorly substantiated", and regretted that the causes of the aircraft's engine failure had not been investigated, considering that this investigation could have led to the accusation of other people.

The lawyer Bárbara Marinho Pinto, who represents the family of the eight-year-old girl who died after being hit by the aircraft, requested a "prison sentence" for Carlos Conde de Almeida, but admitted that it could be replaced by a "flight ban".
