Government maintains extinction of Regional Health Administrations

The Government will maintain the extinction of the Regional Health Administrations (ARS) decided by the previous executive and whose diploma had been returned by the President of the Republic, Marcelo Rebelo de Sousa, said an official source.

When questioned by Lusa about this matter, the Ministry of Health replied that "the extinction of the ARS is awaiting a new decree-law soon".

On the 10th, the President of the Republic had informed that he had only received the decree-law from the previous executive that extinguishes the regional health administrations (ARS) on March 27th and that he had sent it to the new Government, after its inauguration, so that it could comment on the diploma.

The note was published on the official website of the Presidency of the Republic on the Internet after the newspaper Expresso reported that the head of state had not signed the decree-law extinguishing the ARS, pointing to a deadlock situation in relation to this reform.

At issue is a decree-law from the previous PS Government approved in the Council of Ministers on March 21st which, following the creation of the Executive Directorate of the National Health Service (SNS) and the generalization of local health units, proceeds with the extinction of the ARS.

In the note, the Presidency of the Republic informed that the diploma of the previous Government regarding the extinction of the ARS only entered the Palácio de Belém for appreciation on March 27, 2024.

The Presidency of the Republic also highlights that this decree-law was approved "11 days after the early legislative elections" of March 10th.

"It should be recalled that the ARS, despite the reduction of their role, continued and continue to exist in the SNS reform diplomas. Both in 2022, in Decree-Law no. 52/2022, of August 4th, and in Decree-Law no. 61/2022, of September 23rd, and also in 2023, in Decree-Law no. 36/2023, of May 26th, referring to the regional coordination and development commissions (CCDR)", added the note.

Under the terms of article 233 of the Constitution, "within forty days of receiving any government decree to be promulgated, or of the publication of the decision of the Constitutional Court that does not declare the unconstitutionality of a norm contained therein, the President of the Republic must promulgate it or exercise the right of veto, communicating in writing to the Government the reason for the veto".

In this case, the 40-day period, starting from March 27th, has already expired.
