Portugal was again condemned today by the European Court of Human Rights (ECHR) due to the poor conditions of the Estabelecimento Prisional de Lisboa (EPL), having to pay almost 25 thousand euros to two citizens.

The complaint was filed by Plácido Carvalho, who was detained in the EPL between November 2020 and June 2023, and by Rogério Ferreira, who remained in that prison between December 2020 and February 2023.

The court based in Strasbourg ordered the Portuguese State to compensate the two citizens within three months in the amount of 12,800 and 11,200 euros, respectively, and also awarded an additional 250 euros to each for legal expenses.

According to this court, the case involved violations of Articles 3 and 13 of the European Convention on Human Rights, which provide that no one may be subjected to torture, inhuman or degrading treatment or punishment, and that the person whose rights have been violated in any way has the right to an effective remedy.

According to the decision released today, among the main complaints of the two citizens regarding their stay in cells measuring three square meters in the EPL were "lack or inadequacy of furniture, moldy or dirty cell, inadequate temperature, lack or insufficient electric light", natural light and fresh air, and failures in the sanitary facilities and in the supply of personal hygiene items.

Failures in the quality and quantity of food, in medical care, overcrowding and infestation of the cell with insects or rats were also identified.

"The court notes that the applicants were held in detention in precarious conditions", acknowledged the ECHR, adding that "a serious lack of space in a prison cell weighs heavily as a factor to be taken into account for the purposes of determining whether the conditions of detention described are 'degrading'".

Therefore, the court assumed that "it did not find any fact or argument capable of persuading it to reach a different conclusion on the admissibility and merits of these complaints".
