Young man suspected of killing his father in Peniche is tried in the Court of Leiria

The Leiria Judicial Court will try a 21-year-old young man accused by the Public Prosecutor's Office (MP) of the crime of qualified homicide of his father, which occurred on August 16, 2023, in Peniche.

According to the indictment to which the Lusa agency had access today, the suspect, who is in preventive detention, started a verbal confrontation with his father that day, at the residence of the family with whom he lived, because he was convinced that his father "practiced sexual acts" with a minor daughter and sister of the defendant.

The Public Prosecutor's Office explained that the victim managed to leave the house and, despite the defendant's mother trying to prevent him from going after his father, closing the door on one of her son's hands, the young man managed to free himself and started running towards his father, in the street, carrying a knife in his hand.

"After running a few meters, the defendant caught up with his father and, from that moment on, whenever he got close enough", he struck him in various parts of his body with the knife, the Public Prosecutor's Office described, in an order seconded in the criminal investigation court.

The victim "still managed to run a few more meters, although he continued to suffer blows inflicted by the defendant", but the defendant "ended up catching up with his father and, using extreme physical force, inflicted an unspecified number of blows to his back".

According to the document, the young man pushed his father, "causing him to hit his head against a wall", and he fell unconscious to the ground, and, "using extreme physical force, again inflicted" blows with the knife on various parts of his father's body.

The defendant only stopped when the sirens of the security forces and medical assistance that were approaching the scene began to be heard.

For the Public Prosecutor's Office, the young man knew that he would cause his father's death by intentionally striking him with the knife, some in vital areas.

According to the order, the defendant acted "with the purpose of taking the life" of his father and his conduct was "especially perverse and reprehensible", revealing himself to be "totally indifferent not only to the life of a person, but, in particular, to that of his parent".

The order also states that in 2021 the young man filed a complaint, "alleging that his father practiced sexual acts" with his sister, but the investigation was shelved "because no evidence was found".

The following year, another investigation was opened, and the report "describes the aggressions allegedly practiced by the defendant" on his father, which resulted in fractures and hospitalization, but it was also shelved because the parents refused to make statements.

Following the facts that gave rise to this 2022 investigation, the young man was compulsorily hospitalized.

The investigation decision added that, "although the defendant has not been subjected to an expert examination, the Court has no doubt that the defendant suffers from mental illness, having been hospitalized twice before his arrest".

In this sense, it ordered the Directorate-General for Reintegration and Prison Services to inform whether there is availability to place him in an establishment appropriate to his situation, for a possible change in the coercive measures.

The trial, by a collective court, has not yet been scheduled.
