Portugal. European Commission targets data governance law shortcomings

The European Commission decided today to open infringement proceedings against Portugal and 17 other Member States for failing to designate the authorities responsible for enforcing the law on data governance, within the scope of the digital economy.

At issue, according to a statement, is the absence of designation of the authorities responsible for enforcing the law on data governance or the lack of demonstration of their respective authorization to perform the tasks required by European Union law on data governance.

The law on data governance, which entered into force on 24 September 2023, facilitates data sharing between sectors and EU countries, for the benefit of citizens and businesses.

The competent authorities are responsible for registering data altruism organisations and for monitoring the compliance of data intermediary service providers.

The Commission is sending a letter of formal notice to the 18 Member States concerned, which now have two months to respond and resolve the gaps identified.

In the absence of a satisfactory response, the Community executive may decide to issue a reasoned opinion, the second stage of the infringement procedure.
