An Australian court on Thursday refused to extend an interim injunction requiring social media company X (formerly Twitter) to globally block images of the April attack on a Sydney bishop.

"The application to extend the interim order made on 22 April 2024 is dismissed," said Justice Geoffrey Kennett of the Australian Federal Court, who will later publish his reasons for the decision.

On 15 April, a 16-year-old boy repeatedly stabbed Bishop Mar Mari Emmanuel – who survived the attack – while he was celebrating mass at an Assyrian church in western Sydney, which was being livestreamed.

The eSafety Commissioner asked social media companies to remove footage of the attack, which was deemed a terrorist incident, but X – unlike Meta, which owns Facebook and Instagram – refused, triggering a legal stoush.

eSafety Commissioner Julie Inman Grant ordered X to remove more than 60 links globally and threatened the social media company with hefty fines under a law passed in 2021.

Justice Kennett imposed the injunction on 22 April to block the content worldwide, which was extended three times but expired on Monday.

X has only blocked the videos in Australia, according to the ABC, arguing the commissioner does not have jurisdiction outside the country and citing the right to freedom of speech.

On Friday, Justice Kennett set a new hearing date of 15 May to schedule – likely for June – a trial over X’s failure to comply with the commissioner’s original request.

X’s refusal to take down the videos prompted the Albanese government to announce on Friday it would establish a parliamentary inquiry to examine the impact of harmful or illegal content on social media.
